Article 1. Purpose
These Terms of Service are intended to regulate the terms and conditions of use and operation of the services provided by "Spliner3D (www.spliner.ai)" (hereinafter referred to as the "Site").
Article 2. Definition of Terms
The main terms used in these Terms are defined as follows:
① Member: A user who agrees to the Site's terms, provides personal information, registers as a member, enters into a usage contract with the Site, and uses the Site.
② Usage Contract: A contract concluded between the Site and a member regarding the use of the Site.
③ Member ID: A unique combination of letters and numbers assigned to each member for member identification and service use.
④ Password: A combination of letters and numbers selected by the member to confirm that they are the member matching the assigned ID and to protect the member's rights.
⑤ Operator: The operator who establishes and operates a homepage on the service.
⑥ Termination: A member's cancellation of the usage contract.
Article 3. Rules Other Than Terms
The operator may separately announce and guide operational policies when necessary, and when these Terms and operational policies overlap, the operational policies shall take precedence.
Article 4. Conclusion of Usage Contract
① The usage contract is established by the consent of a person who wishes to register as a member and use the Site to the contents of these Terms and the operator's acceptance of the membership application.
② A person who wishes to register as a member and use the service shall express their consent to these Terms by reading these Terms and selecting "I agree" below when applying for Site membership.
Article 5. Service Use Application
① Users who wish to register as members and use the Site must provide all information requested by the Site (user ID, password, nickname, etc.).
② Members who do not register their genuine information, such as stealing others' information or registering false information, cannot claim any rights regarding Site use and may be punished according to relevant laws.
Article 6. Personal Information Processing Policy
The Site and operator do not possess passwords among the personal information provided during member registration, and related matters follow the Site's Personal Information Processing Policy.
The operator strives to protect members' personal information, including member registration information, in accordance with relevant laws.
Member personal information protection follows relevant laws and the Personal Information Processing Policy established by the Site.
However, the operator assumes no responsibility for information exposed due to the member's fault.
When members register and distribute illegal posts that harm public morals or threaten national security, the operator may view member data and submit such data to relevant agencies upon request from related institutions.
Article 7. Operator's Obligations
① When the operator recognizes that opinions or complaints raised by members are legitimate, they should process them as quickly as possible. However, when prompt processing is difficult due to personal circumstances, they will do their best by subsequently posting notices or sending messages, emails, etc. to members.
② For continuous and stable Site provision, when equipment fails or is lost, the operator may request the Site to repair or restore it without delay. However, in case of natural disasters or unavoidable circumstances for the Site or operator, Site operation may be temporarily suspended.
Article 8. Member's Obligations
① Members must comply with matters stipulated in these Terms, various regulations established by the operator, notices, operational policies, and other matters announced by the Site, as well as relevant laws, and must not engage in acts that interfere with the Site's business or damage the Site's reputation.
② Members cannot transfer or donate service usage rights or other usage contract positions to others without the Site's explicit consent, nor can they provide them as collateral.
③ Users must exercise considerable care in managing their ID and password and cannot provide their ID to third parties for use without the operator's or Site's consent.
④ Members must not infringe upon the intellectual property rights of the operator, Site, and third parties.
Article 9. Service Use Hours
① Service use hours are in principle 24 hours a day, year-round, unless there are special business or technical obstacles. However, the Site may temporarily suspend service on days or times designated by the Site for system regular inspection, expansion, and replacement, and service temporary suspension due to scheduled work is announced in advance on the Site's homepage, so please refer to it from time to time.
② However, the Site may temporarily or permanently suspend service without prior notice or warning in the following cases:
- Emergency system inspection, expansion, replacement, failure, or malfunction
- Force majeure circumstances such as national emergency, power outage, natural disasters
- When telecommunications business operators stipulated in the Telecommunications Business Act suspend telecommunications services
- When there is interference with normal service use due to service use congestion, etc.
③ In case of service suspension under the preceding paragraph, the Site notifies members in advance through notices, etc. However, when prior notice is impossible due to service suspension caused by reasons beyond the Site's control, it will be replaced with subsequent notice.
Article 10. Service Use Termination
① When a member wishes to terminate the usage contract with the Site, the member must apply for registration termination online. Meanwhile, termination of the usage contract with the Site must be done separately from Site use termination.
② Upon termination application, Site-related programs provided by the Site are automatically deleted from the member management screen, so the operator can no longer view the termination applicant's information.
Article 11. Service Use Restrictions
Members must not engage in the following acts, and when such acts are committed, the Site may restrict the member's service use and take legal measures, terminate the usage contract, or suspend service for a specified period:
- Registering false information during member registration or when changing information after registration
- Interfering with others' Site use or stealing information
- Impersonating Site management, staff, or related personnel
- Infringing upon personality rights or intellectual property rights of the Site or other third parties, or interfering with business
- Illegally using other members' IDs
- Collecting, storing, or disclosing other members' personal information without their consent
- Acts objectively judged to be connected with crime
- Other acts violating relevant laws
Article 12. Post Management
① The responsibility for managing and operating posts and materials on the Site lies with the operator. The operator must always monitor inappropriate posts and materials, and when inappropriate posts and materials are discovered or reported, they must delete the relevant posts and materials and warn the member who registered them.
Meanwhile, members are responsible for posts uploaded by users, so members should not post content that violates these Terms of Use.
② When there are correction requests from public institutions such as the Korea Communications Standards Commission, the operator may delete or move posts without prior consent from members.
③ Criteria for judging inappropriate posts are as follows:
- Content that severely insults other members or third parties or damages their reputation
- Distributing or linking content that violates public order and morals
- Content encouraging illegal copying or hacking
- Commercial advertisements for profit purposes
- Content objectively recognized as connected with crime
- Infringing upon copyrights or other rights of other users or third parties
- Other cases judged to violate relevant laws
Article 13. Post Storage
When the Site operator must discontinue this Site due to unavoidable circumstances, they will make advance notice to members and strive to take all measures to facilitate post transfer.
Article 14. Copyright of Posts
① Copyright of posts posted by members within the Site belongs to the posting member. Also, the Site cannot use posts commercially without the poster's consent. However, this does not apply to non-profit purposes, and the Site also has posting rights within the service.
② Members cannot commercially use materials posted on the service, such as arbitrarily processing or selling information acquired through service use.
③ The operator may delete, move, or refuse registration without prior notice when judging that content posted or registered by members within the Site corresponds to each item of Article 12.
Article 15. Damage Compensation
① All civil and criminal legal responsibilities arising from this Site primarily lie with the member.
② When damage received by members from this Site is due to force majeure such as natural disasters or the member's intent or negligence, no damage compensation will be provided.
Article 16. Disclaimer
① The operator is exempt from responsibility for damages arising from members not obtaining expected benefits from the Site's service provision or from selection or use of service materials.
② The operator is exempt from responsibility in cases of failures in this Site's service infrastructure and telecommunications services provided by other telecommunications operators, and for damages related to this Site's service infrastructure, the Site's Terms of Use apply.
③ The operator assumes no responsibility regarding materials stored, posted, or transmitted by members.
④ The operator is not responsible when service use failures occur due to members' fault.
⑤ The operator assumes no responsibility for all activities between members or between members and third parties, regardless of whether within or outside this service (including data transmission and other community activities).
⑥ The operator assumes no responsibility for the authenticity, reliability, accuracy, and other content of materials posted or transmitted by members and all materials that members can receive through this Site.
⑦ The operator assumes no responsibility for all damages arising from goods transactions between members or between members and third parties mediated through the service.
⑧ The operator assumes no responsibility for all disputes arising between members or between members and third parties without the operator's fault.
⑨ The operator assumes no responsibility for member damages due to system failures that may occur without intent or gross negligence equivalent to intent during server and other equipment management, inspection, maintenance, replacement processes or software operation processes, system failures due to third-party attacks, distribution of computer viruses for which response methods have not been developed by renowned domestic and foreign research institutions or security-related companies, or other force majeure circumstances beyond the operator's control.
